J. Mark Smith has over 40 years of experience representing clients in intellectual property litigation and transactional counseling. His litigation practice includes patents, trademarks, trade secrets, copyrights, software, technology and computer disputes, and other related matters. His trademark litigation includes practice before the Trademark Trial and Appeal Board, federal, and state courts. He has robust trial experience in the enforcement of intellectual property rights.
On the transaction side, Mark counsels clients in due diligence, transaction negotiation, and risk avoidance in the same areas of the law listed above. He advises clients on business and competitive conduct, rights clearance, infringement, and right to use opinions. His counsel on, intellectual property issues is useful in M&A due diligence, joint ventures, licensing, employee and consultant rights, distributor relationships, and internet and software transactions. Mark also advises on data breach response and notification compliance.
He represents clients before the Copyright Office and Trademark Office in order to register clients’ rights for enhanced protection of their valuable works and brands.
